Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Balmly application (the "Service"), operated by Jari-Pekka Huuskonen, an individual sole proprietor ("Balmly," "we," "us," "our").

By downloading, accessing, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

1. Not a Medical, Counseling, or Crisis Service

THE SERVICE IS NOT A MEDICAL DEVICE, MENTAL HEALTH SERVICE, CRISIS RESPONSE SERVICE, THERAPY, COUNSELING, OR HEALTHCARE PROVIDER, AND DOES NOT GIVE MEDICAL, PSYCHIATRIC, OR CLINICAL ADVICE.

ALL CONTENT GENERATED BY THE SERVICE IS FOR INFORMATIONAL, REFLECTION, SPIRITUAL, AND WELLNESS PURPOSES ONLY. NEVER RELY ON THE SERVICE FOR MEDICAL, MENTAL HEALTH, OR EMERGENCY DECISIONS.

IF YOU OR SOMEONE ELSE MAY BE IN IMMEDIATE DANGER, EXPERIENCING SUICIDAL THOUGHTS, OR AT RISK OF HARM, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.

2. Eligibility

You must be at least 18 years old and legally able to enter this agreement to use the Service. The Service is not directed to anyone under 18, and we do not knowingly collect information from anyone under 18.

3. What the Service Does

The Service uses AI to generate a message, Bible verse, and prayer intended for you to send to someone else. It is a user-directed software tool, not professional advice. We do not warrant that any generated content is accurate, complete, or suitable for any particular situation.

The Service only creates a suggested message. The decision to send it, and to whom, is entirely yours. You are solely responsible for how the recipient reacts to or is affected by any message you choose to send.

4. AI Output Disclaimer

AI-generated content may be inaccurate, incomplete, or inappropriate, and may not reflect our views. You are solely responsible for reviewing and deciding whether to send any generated content. No output constitutes professional, clinical, or emergency guidance.

5. Crisis and Safety Limitations

We do not undertake any duty to monitor your safety or well-being, and the Service is not continuously monitored by a human. We do not guarantee that the Service will identify suicidal ideation, self-harm, violence, or other risk, and we have no obligation to contact emergency responders, family, or law enforcement.

Any safety message or crisis-related notice shown by the Service is informational only and does not create a duty of care or special relationship.

6. Acceptable Use

You agree not to use the Service to violate any law; harass, threaten, or abuse any person; generate unlawful or violent content; impersonate someone; distribute malware; interfere with the Service; or attempt unauthorized access to our systems. We may remove content or restrict access at any time.

You also agree not to use the Service for medical diagnosis, emergency response, suicide risk assessment, or any other high-risk decision-making — it is not designed or authorized for such uses.

7. Your Content

You retain ownership of content you submit. You grant us a limited license to process it solely to provide the Service. You represent that you have the right to submit it and that it doesn't violate any law or third-party right.

Per our Privacy Policy, the description you write is processed transiently and not stored on our servers after your request completes.

8. Our Intellectual Property

Except for your content, all rights in the Service — software, design, text, trademarks — belong to us. No rights are transferred to you.

9. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR SAFE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING EMOTIONAL DISTRESS OR LOST DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12. Indemnification

You agree to defend and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or the law.

13. No Fiduciary or Special Relationship

Using the Service does not create any fiduciary, therapist-patient, counselor-client, or other special relationship between you and us. We assume no duty of care, duty to warn, or duty to monitor. Your use is voluntary; the Service is an informational software tool.

14. Assumption of Risk

You voluntarily assume all risk from using the Service, including emotional distress, inaccurate content, and any interpersonal consequences of content you choose to send to someone else. AI-generated content may contain errors — reliance on it is at your own risk.

15. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware. Any dispute shall be brought exclusively in the state or federal courts located in Delaware, and you agree to personal jurisdiction there. You and Balmly each waive any right to a class action, class arbitration, or representative action — all claims must be brought individually. Nothing here prevents either party from using small claims court for qualifying claims.

16. Third-Party Services

The Service relies on third-party providers including Anthropic (AI processing) and RevenueCat (payment processing). We are not responsible for the availability or reliability of these services; your use of them may be subject to their own terms.

Purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms, billing, and refund policies. We do not handle your payment card details directly.

17. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any lawful reason.

18. Changes to These Terms

We may update these Terms at any time. Continued use after an update means you accept the revised Terms.

19. General

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. Nothing here limits any non-waivable consumer protection right you have under applicable law.
